Terms of Use
1. Acceptance of Terms
By creating an account, uploading, storing, downloading, or otherwise using HatFile, hereinafter referred to as the “Service”, you agree to be bound by these Terms of Service.
If you do not agree with any part of these Terms, you must not use the Service.
2. Description of the Service
HatFile is an online file storage and file-sharing platform that allows users to upload, store, manage, download, and share digital files.
HatFile acts solely as a technical hosting and storage provider. HatFile does not create, select, modify, approve, endorse, or verify files uploaded by users.
3. User Responsibility
Each user is solely responsible for all files uploaded, stored, shared, or otherwise made available through their account.
In particular, users are responsible for:
- ensuring that they have the legal right to upload, store, and distribute each file;
- obtaining all required licences, permissions, and authorisations;
- ensuring that uploaded files comply with applicable laws and regulations;
- protecting their account credentials and preventing unauthorised access;
- all actions performed through their account.
Users must not upload or distribute files that infringe copyright, trademark, patent, privacy, publicity, contractual, or other intellectual property rights.
4. Ownership of Uploaded Files
Files uploaded to HatFile remain the property of the user or the respective copyright holder.
Uploading a file to HatFile does not transfer ownership, copyright, or other intellectual property rights to HatFile.
By uploading a file, the user represents and warrants that they either own the file or have all necessary rights, permissions, and licences required to store, share, and distribute it.
The user grants HatFile only the limited technical rights necessary to store, process, transmit, display, reproduce, and deliver the file for the purpose of providing the Service.
5. Copyright and Intellectual Property Rights
Users may upload only files that they legally own or are legally authorised to use and distribute.
Uploading, storing, or sharing copyrighted material without the permission of the copyright holder is prohibited.
HatFile respects intellectual property rights and may remove or restrict access to files after receiving a valid copyright infringement notification.
Copyright and DMCA infringement reports must be submitted through:
https://hatfile.com/dmca6. No Responsibility for User-Uploaded Files
HatFile provides technical infrastructure for file storage and transmission only.
To the maximum extent permitted by applicable law, HatFile, its owners, administrators, employees, contractors, and partners are not responsible for:
- files uploaded, stored, or shared by users;
- the legality, accuracy, quality, or reliability of user-uploaded files;
- copyright or intellectual property infringements committed by users;
- damage caused by downloading, opening, or using a stored file;
- malware, viruses, harmful code, or corrupted files uploaded by users;
- loss of files, data, profits, revenue, or business opportunities;
- unauthorised access to files caused by the actions of a user;
- claims resulting from a user’s violation of applicable law.
The user who uploads or distributes a file bears full legal responsibility for that file.
HatFile must not be treated as the author, publisher, editor, owner, or distributor of user-uploaded files solely because such files are stored on its infrastructure.
7. Prohibited Content and Activities
Users must not upload, store, share, distribute, promote, or link to content that is unlawful or violates these Terms.
Prohibited content and activities include, without limitation:
- copyrighted content distributed without authorisation;
- malware, viruses, ransomware, spyware, or other malicious software;
- phishing pages, fraudulent documents, or content used for identity theft;
- stolen, leaked, or unlawfully obtained personal or confidential data;
- child sexual abuse material or content exploiting minors;
- content promoting terrorism or unlawful violent activity;
- content whose possession or distribution is prohibited by law;
- software, keys, or tools intended to bypass licensing or security systems;
- files used to harass, threaten, defame, impersonate, or unlawfully harm others;
- attempts to abuse, overload, scan, attack, or disrupt the Service;
- automated downloading or uploading that bypasses technical restrictions;
- reselling or transferring account access without authorisation.
HatFile may remove prohibited content, restrict access to files, suspend accounts, terminate accounts, and preserve relevant evidence where required by law.
8. File Storage and Retention Period
Files may be stored for a period ranging from 7 to 365 days.
The exact retention period may depend on the user’s account type, Premium plan, file activity, promotional conditions, technical limitations, or other rules applicable to the Service.
The retention period may be calculated from the date of upload, the date of the last download, the date of the last account activity, or another event specified for the relevant account or plan.
Files whose retention period has expired may be deleted automatically and permanently without prior notice.
Users are responsible for maintaining their own backup copies. HatFile must not be used as the only backup location for important files.
9. Premium Accounts
Premium accounts may provide increased file retention periods, higher download limits, faster downloads, reduced waiting times, or other additional features.
Available Premium plans, prices, validity periods, and included limits are presented on the Premium purchase page.
Premium accounts can be purchased at:
https://hatfile.com/premiumPremium access is assigned to the purchasing account and may not be shared, resold, transferred, or made available to third parties unless HatFile expressly permits it.
10. Daily Download Limits
HatFile applies daily download transfer limits depending on the account type or Premium plan.
Daily download limits may range from 10 GB to 100 GB per day.
The applicable limit is displayed in the account, Premium offer, or plan description.
Download transfer may be calculated using the full size of each requested file, including interrupted, repeated, resumed, or unsuccessful download attempts where the data was transmitted by the Service.
Daily download limits are reset according to UTC time.
The reset takes place based on Coordinated Universal Time and not according to the user’s local timezone.
Unused daily download transfer does not accumulate and is not carried over to the next day.
HatFile may temporarily restrict downloads where unusual activity, account sharing, automated access, abuse, fraud, or attempts to bypass limits are detected.
11. File Availability and Data Loss
HatFile does not guarantee that any file will remain available for a specific period unless such a guarantee is expressly stated in writing.
Files may become unavailable or be deleted because of:
- expiration of the retention period;
- account suspension or termination;
- a valid copyright or legal complaint;
- a violation of these Terms;
- hardware, software, storage, or network failure;
- security incidents or data corruption;
- maintenance or infrastructure migration;
- events outside HatFile’s reasonable control.
Users should keep independent backup copies of all important files.
12. Service Availability
HatFile aims to provide reliable access to the Service but does not guarantee uninterrupted, error-free, secure, or continuously available operation.
The Service may be suspended, restricted, or unavailable because of maintenance, upgrades, technical failures, cyberattacks, network problems, third-party service failures, legal requirements, or force majeure events.
HatFile may modify, suspend, discontinue, or replace any part of the Service where reasonably necessary.
13. Account Suspension and Termination
HatFile may suspend, restrict, or terminate an account where the user:
- violates these Terms;
- uploads or distributes unlawful content;
- repeatedly infringes intellectual property rights;
- shares, resells, or transfers Premium access without permission;
- attempts to bypass technical restrictions or download limits;
- uses automated tools in a manner harmful to the Service;
- creates multiple accounts to avoid restrictions;
- engages in fraud, payment abuse, chargeback abuse, or account theft;
- threatens the security or stability of the Service.
Suspension or termination may occur without prior notice where immediate action is necessary to protect users, infrastructure, third parties, or HatFile.
14. Limitation of Liability
The Service is provided on an “as is” and “as available” basis.
To the maximum extent permitted by applicable law, HatFile disclaims all warranties regarding availability, security, suitability, accuracy, merchantability, fitness for a particular purpose, and non-infringement.
HatFile shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, loss of revenue, loss of reputation, business interruption, or loss of access to stored files.
Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.
15. Indemnification
To the extent permitted by applicable law, the user agrees to indemnify and hold harmless HatFile, its owners, administrators, employees, contractors, and partners from claims, damages, losses, liabilities, and reasonable costs arising from:
- files uploaded or distributed by the user;
- the user’s violation of these Terms;
- the user’s violation of applicable law;
- the infringement of third-party rights by the user;
- the misuse of the user’s account.
16. Privacy and Account Information
Personal data and account information are processed in accordance with the applicable Privacy Policy and data protection laws.
Users are responsible for providing accurate account information and keeping their login credentials confidential.
17. Contact and Support

Updated Terms become effective when published on the Service unless another effective date is stated.
Continued use of HatFile after updated Terms become effective constitutes acceptance of the updated Terms.
19. Final Provisions
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.
Failure by HatFile to enforce any provision does not constitute a waiver of that provision or any other right.
By using HatFile, the user confirms that they understand that legal responsibility for uploaded files remains with the person who uploaded or distributed them.
